There is a specific procedure that we have worked
out for making a Non-Disclosure Agreement (NDA) very specific and time limited.
It is called a IP Glass Bead Game and
uses a Groove collaborative environment “IP Sandbox”.
The guiding social behavioral pattern is the
doctoral committee and the doctoral candidate.
The candidate makes a proposal that is then
considered by a committee. By principle
the committee serves the candidate’s interest.
The candidate has made a claim that he/she has

developed an original contribution to the scholarly literature
2)
made a complete and extensive review of all relevant scholarship
3)
is able to demonstrate competence in a field of scholarship
The committee makes an evaluation of this claim and
may help the candidate in fully developing the contribution.
In analogy to the doctoral committee, the Consulting
Committee for a IP Sandbox, serves the candidate in his/her attempt to make
clear a claim that there is an original contribution, that a complete
literature review has been made, and that the candidate is able to demonstrate
competence in a relevant field of application.
The enforcement mechanism for the IP Sandbox takes
into account the experience and knowledge of the Consulting Committee. Thus it is assumed that each member of the
Consulting Committee will almost immediately understand the candidate’s
invention/discovery. Moreover, it is
assumed that in interacting with the candidate that individual members of the
committee will develop new intellectual property based on and similar to the
candidate’s invention/discovery.
Time is therefore of essence. To allow the candidate a specific period of time to use US
Constitutional provision for patent protection, a period of 6 weeks is provided
once the Glass Bead Game begins. During
this time, the individual members of the Consulting Committee enter into a
subject specific Non-Disclosure Agreement (NDA). The NDA is developed as a binding legal agreement between
parties, not to include OntologyStream Inc or the BCNGroup Org as a participant
in the NDA. During this six-week period
the candidate will be assisted in developing the concept and the reduction to
practice required of a patent application.
Ownership is the key issue. The candidate will compensate the members of the Consulting
Committee. Specific terms are set into
the governing NDA. The filing of the patent is made entirely the responsibility
of the candidate. The candidate will
own relevant patent applications filed during the six-week period of time.
At the end of the six weeks period, it is deemed
that no persistent legal binding are enforceable based on the signed NDA.
